Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of the Arkyn website, its documentation (currently hosted at docs.arkyn.dev), and any related official channels (together, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms concern your use of the Site. Your use of Arkyn's software packages is instead governed by License, and processing of your personal data is governed by Privacy Policy. All three documents apply together where relevant.

2. Definitions

See Arkyn Legal Documentation for the shared glossary used across Arkyn's legal documentation. In these Terms, "Site" specifically means the Arkyn website and Documentation as described in Section 1, excluding the Software itself.

3. Scope

These Terms apply to anyone who accesses the Site, including developers browsing the Documentation, users of the interactive search and navigation features, and anyone submitting a form (such as the newsletter signup) through the Site.
These Terms do not govern:
  • Your use of Arkyn's npm packages in your own applications (see License).
  • Content or services operated by third parties that the Site merely links to (see Section 7).
  • Any dedicated terms of service published for a specific paid or hosted Arkyn service, which will supersede these general Terms for that service once such terms exist.

4. Using the Website and Documentation

You may use the Site to learn about, evaluate, and integrate Arkyn's packages into your own projects. In using the Site, you agree that you will:
  • Provide accurate information in any form you submit (such as the newsletter or contact form).
  • Use the Site only for lawful purposes and in a manner consistent with these Terms.
  • Respect the intellectual property rights described in Section 6 and in Brand, Trademark & Copyright Policy.

5. Acceptable Use Policy

Regardless of your reason for accessing the Site, you agree not to:
  • Send spam, unsolicited bulk communications, or fraudulent submissions through any form on the Site.
  • Distribute malware, viruses, or other malicious code through the Site (for example, via comments, issues, or file uploads, where applicable).
  • Attempt to steal, phish for, or otherwise misuse credentials belonging to the Maintainer, contributors, or other users.
  • Interfere with, degrade, or disrupt the Site's operation, including through denial-of-service attacks, automated request flooding, or deliberate resource exhaustion.
  • Use automated tools to scrape, mirror, or bulk-download the Documentation in a manner that is unauthorized, excessive, or that circumvents technical access controls. (Reasonable, well-behaved automated access — for example, a search engine crawler respecting robots.txt, or a personal script fetching a handful of pages — is not what this prohibits.)
  • Reverse engineer, decompile, or attempt to circumvent the security of any proprietary or paid service Arkyn may offer now or in the future (this does not apply to the open-source Software itself, which you are free to inspect and modify under License).
  • Upload, link to, or distribute illegal content through the Site.
  • Infringe any third party's copyright, trademark, or other intellectual property rights through content you submit to the Site.
  • Misuse the Arkyn name, logo, or brand in violation of Brand, Trademark & Copyright Policy.
  • Harass, threaten, or abuse the Maintainer, contributors, or other members of the community through any official Arkyn channel.
Violations of this section may result in suspension of your access to interactive features of the Site, removal of your content, and, where applicable, referral to law enforcement, without prejudice to any other remedy available to the Maintainer.

6. Intellectual Property

The Site's content, design, and branding are protected as described in Brand, Trademark & Copyright Policy, and Arkyn's Software is licensed as described in License. Nothing in these Terms transfers ownership of any intellectual property to you beyond the specific permissions granted in those two documents.

7. External Services and Third-Party Links

The Site may link to or embed third-party services (for example, GitHub, npm, Figma, analytics providers, or social media platforms). The Maintainer does not control and is not responsible for the content, policies, or practices of those third parties. Your use of any third-party service is governed by that service's own terms.

8. Future and Optional Services

Arkyn may, in the future, offer additional tooling, APIs, monitoring or observability features, or optional cloud services. Unless and until dedicated terms are published for such a service, your use of any preview or beta feature of this kind is offered "as is," may change or be discontinued at any time, and is additionally subject to the Acceptable Use Policy in Section 5 and to Privacy Policy for any data processed through it.

9. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Maintainer does not warrant that the Site will be uninterrupted, error-free, or completely secure. This mirrors, for the Site, the same "as is" principle already stated for the Software in License.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Maintainer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Site, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for fraud or willful misconduct).

11. Suspension and Termination

The Maintainer may suspend or restrict your access to interactive features of the Site (such as forms or search) at any time, with or without notice, if the Maintainer reasonably believes you have violated these Terms, in particular the Acceptable Use Policy in Section 5. Because the core Documentation is intended to be freely and publicly readable, suspension will generally target abuse of interactive features rather than read access to published pages.

12. Changes to These Terms

These Terms may be updated from time to time to reflect changes to the Site or to legal requirements. The current version is always the one published at this file's location, with the "Last Updated" date at the top. Material changes will be noted in the Documentation's changelog where practical.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Brazil, without regard to its conflict-of-law principles, reflecting the Maintainer's actual base of operations. Any dispute arising from these Terms will first be addressed through good-faith direct communication (see Section 14); if unresolved, it will be subject to the jurisdiction of the courts of Brazil, except where applicable consumer-protection or mandatory local law gives you the right to a different forum.
